These Terms of Service (“Terms”) govern your use of VoSci’s website, platform, and services (collectively, the “Service”). By creating an account or using our Service, you agree to these Terms.

Please read these Terms carefully before using VoSci.

If you do not agree to these Terms, you may not use our Service.

1. Acceptance of Terms

By accessing or using VoSci, you agree to:

  1. These Terms of Service
  2. Our Privacy Policy
  3. Any additional terms specific to features you use

If you are under 18, you must have parental or guardian consent to use VoSci.

2. Account Registration and Requirements

2.1 Account Creation

To access most features of VoSci, you must create an account by providing:

  • A valid email address
  • A secure password
  • Optional profile information (name, instrument, etc.)

2.2 Account Responsibility

You are responsible for:

  • ✅ Maintaining the confidentiality of your login credentials
  • ✅ All activities that occur under your account
  • ✅ Notifying us immediately of any unauthorized access
  • ✅ Ensuring your account information is accurate and up-to-date

Password Security: Your password is managed entirely by Memberstack (our authentication provider). We never see, store, or have access to your password.

You may not:

  • ❌ Share your account with others
  • ❌ Create multiple accounts to abuse features (e.g., free trials)
  • ❌ Use another person’s account without permission
  • ❌ Use automated bots or scripts to create accounts

2.3 Age Requirements

  • You must be 13 years or older to create an account
  • Users under 18 require parental consent
  • Teachers are responsible for ensuring student compliance

3. Practice Activity Tracking (Required for Service)

3.1 Tracking is Mandatory for Members

By creating an account with VoSci Academy, you explicitly consent to practice activity tracking.

This tracking is necessary to provide our service, which includes:

  • ✅ Your personalized progress dashboard
  • ✅ Points, achievements, and streak tracking
  • ✅ Personalized practice recommendations
  • ✅ Teacher oversight features (if enrolled in a class)
  • ✅ Historical practice data and analytics
  • ✅ Learning insights and skill development tracking

Legal Basis (GDPR): Contract performance – Tracking is an essential component of our educational service and cannot be disabled while maintaining an active account.

3.2 What We Track

For all registered users, we automatically track:

Practice time Calculate credits, achievements, and progress
Practice category Identify skill areas (Ear Training, Sight Reading, etc.)
Pages visited Understand which exercises you use
Session data Track when you start/end practice sessions
Interaction events Monitor button clicks, feature usage for UX improvement

3.3 Opt-Out = Account Cancellation

If you do not wish to have your practice activity tracked, you must cancel your VoSci Academy account.

  • Tracking cannot be disabled while maintaining an active account
  • Upon account cancellation, all tracking ceases immediately
  • Data deletion requires membership cancellation first – Your account and practice data remain accessible after cancellation unless you explicitly request deletion

To cancel your account: Use the support widget on our website or the account settings page.

3.4 Anonymous Visitors (No Account)

If you visit VoSci without creating an account:

  • ✅ Session-only tracking applies (data auto-deletes when you close your browser)
  • ✅ No persistent tracking across visits
  • ✅ No login required for basic features (e.g., Vocal Range Profile tool)

4. Subscription and Payment Terms

4.1 Subscription Plans

VoSci offers:

  • Individual Subscription – Full access to all exercises and features
  • Teacher/Studio Subscriptions – Classroom management and student tracking

Current pricing is available at www.voicescience.org/academy.

4.2 Billing and Renewal

  • Subscriptions are billed monthly or annually (as selected)
  • Auto-renewal – Your subscription automatically renews unless canceled
  • Payment methods – Credit card, debit card (processed via Stripe)
  • Price changes – We’ll notify you 30 days before any price increase

4.3 Cancellation and Refunds

Cancellation:

  • You may cancel anytime from your account settings
  • Cancellation takes effect at the end of the current billing period
  • You retain access until the subscription expires

Refunds:

  • No refunds for partial months or unused subscription time
  • Free trial – Cancel before trial ends to avoid charges
  • Exceptions – Refunds granted at our discretion for billing errors or technical issues

4.4 Free Trials

  • Free trials are available for new users only
  • One free trial per person (no multiple accounts for repeated trials)
  • You must provide payment information to start a trial
  • You’ll be charged automatically when the trial ends unless you cancel

5. User Conduct and Acceptable Use

5.1 Acceptable Use

You agree to use VoSci only for lawful, educational purposes.

You may:

  • ✅ Practice music exercises and lessons
  • ✅ Track your progress and achievements
  • ✅ Share your results with teachers or friends (at your discretion)
  • ✅ Use our tools for personal music education

5.2 Prohibited Activities

You may not:

❌ Violate laws or regulations

  • No illegal activities or content

❌ Abuse or exploit the Service

  • No hacking, reverse engineering, or exploiting bugs for gain
  • No automated scraping or data harvesting
  • No circumventing payment or access controls

❌ Misuse teacher/student features

  • Teachers: No misrepresenting credentials or qualifications
  • Students: No creating fake accounts to bypass teacher oversight

❌ Infringe intellectual property

  • No copying or redistributing our exercises, audio, or content
  • No uploading content you don’t have rights to use

❌ Spam or harass

  • No unsolicited advertising or promotional content
  • No harassment, abusive behavior, or threats

❌ Impersonate or deceive

  • No impersonating VoSci staff, teachers, or other users
  • No misleading profile information

5.3 Consequences of Violations

Violations may result in:

  1. Warning – First offense for minor violations
  2. Temporary suspension – Access restricted for a period
  3. Account termination – Permanent ban for serious or repeated violations
  4. Legal action – For illegal activity, fraud, or significant harm

We reserve the right to terminate accounts at our discretion for violations of these Terms.

6. Intellectual Property Rights

6.1 VoSci Ownership

All content, features, and functionality of VoSci are owned by VoSci and protected by:

  • Copyright
  • Trademark
  • Patent
  • Trade secret laws

This includes:

  • Exercises, lessons, and educational content
  • Audio files and musical recordings
  • Software, code, and algorithms
  • Design, graphics, and user interface
  • VoSci name, logo, and branding

6.2 Your Limited License

VoSci grants you a limited, non-exclusive, non-transferable license to:

  • Access and use the Service for personal educational purposes
  • Download materials explicitly marked as downloadable (e.g., practice sheets)

You may not:

  • Redistribute, sell, or license VoSci content
  • Create derivative works based on our content
  • Remove copyright or trademark notices
  • Use our content for commercial purposes without permission

6.3 User-Generated Content

If you upload content to VoSci (e.g., recordings, notes, profile information):

  • ✅ You retain ownership of your content
  • ✅ You grant VoSci a license to display, process, and store your content to provide the Service
  • ✅ You represent that you have the right to upload the content
  • ✅ You agree not to upload copyrighted material without permission

7. Teacher and Student Accounts

7.1 Teacher Responsibilities

If you create a teacher account, you agree to:

  • ✅ Only enroll students with proper consent (parental consent for minors)
  • ✅ Use student data solely for educational purposes
  • ✅ Respect student privacy and data protection laws
  • ✅ Provide accurate information about your teaching credentials

Teachers may:

  • View student practice progress and analytics
  • Assign exercises and track completion
  • Communicate with students through the platform

Teachers may not:

  • Share student data with unauthorized third parties
  • Use student data for marketing or non-educational purposes
  • Access student accounts without permission

7.2 Student Responsibilities

If you’re enrolled as a student under a teacher account:

  • ✅ Your teacher can view your practice progress
  • ✅ You understand practice tracking is shared with your teacher
  • ✅ You may request to leave a teacher’s class at any time

For Minors:

  • Parent/guardian consent is required for teacher enrollment
  • Teachers may share progress with parents/guardians

8. Data Privacy and Security

8.1 Privacy Policy

Your use of VoSci is also governed by our Privacy Policy, which explains:

  • What data we collect
  • How we use your data
  • Your privacy rights (GDPR, CCPA)
  • Data retention and deletion

8.2 Data Security

We implement industry-standard security measures:

  • 🔒 Encryption in transit – All data transmitted over HTTPS/TLS
  • 🔒 Encryption at rest – Cloudflare D1 and R2 use encryption at rest
  • 🔒 Secure authentication – Managed by Memberstack (industry-standard password hashing)
  • 🔒 Infrastructure security – Cloudflare’s SOC 2 Type II certified platform
  • 🔒 DDoS protection – Cloudflare’s global network protects against attacks
  • 🔒 No password storage – We never see or store your password (handled by Memberstack)

However, no system is 100% secure. You acknowledge that:

  • You use VoSci at your own risk
  • We cannot guarantee absolute security
  • You are responsible for maintaining secure login credentials

8.3 Data Breach Notification

In the event of a data breach affecting your personal information:

  • We’ll notify affected users within 72 hours (GDPR requirement)
  • We’ll report to the relevant authorities as required by law
  • We’ll take immediate action to mitigate harm

9. Service Availability and Modifications

9.1 Service Availability

We strive to provide reliable service, but:

  • ⚠️ No uptime guarantee – Occasional downtime for maintenance or technical issues
  • ⚠️ No warranty – Service is provided “as is” without warranties of any kind
  • ⚠️ We are not liable for losses due to service interruptions

9.2 Service Modifications

We reserve the right to:

  • Modify or discontinue features at any time
  • Change pricing with 30 days’ notice
  • Update exercises, content, or curriculum
  • Change these Terms (see Section 15)

We’ll notify users of significant changes via email or platform notifications.

10. Third-Party Services

VoSci integrates with third-party services:

Memberstack User authentication & password reset emails
Stripe Payment processing & receipt emails
Cloudflare Hosting and analytics
Postmark Practice reminders & achievement notifications (opt-out available)
ActiveCampaign Marketing emails & newsletters (opt-in only)
YouTube Embedded video content (lessons, tutorials)
SoundCloud Embedded audio content (music examples, exercises)

You acknowledge:

  • These services have their own terms and privacy policies
  • We are not responsible for third-party service failures or violations
  • Your use of these services is subject to their terms
  • Embedded content (YouTube, SoundCloud) may set cookies when you play videos or audio – these are controlled by the respective platforms, not by VoSci

11. Disclaimers and Limitation of Liability

11.1 Educational Disclaimers

VoSci provides music education, but:

  • ❌ We are not a substitute for professional instruction
  • ❌ We make no guarantees about learning outcomes or skill improvement
  • ❌ We are not liable for injuries from improper vocal or instrumental technique

Recommendation: Consult a qualified music teacher or vocal coach for personalized instruction.

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

VoSci, its owners, employees, and affiliates are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Service interruptions or technical failures
  • User errors or misuse of the Service
  • Third-party service failures

Maximum liability is limited to the amount you paid for VoSci in the 12 months prior to the claim (or $100, whichever is greater).

11.3 Warranty Disclaimer

VOSCI IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability

12. Indemnification

You agree to indemnify and hold harmless VoSci from any claims, damages, or expenses arising from:

  • Your violation of these Terms
  • Your misuse of the Service
  • Your violation of any law or regulation
  • Your infringement of third-party rights
  • Content you upload to the Service

13. Dispute Resolution

13.1 Informal Resolution

Before filing a legal claim, you agree to:

  1. Use the support widget on our website to describe the issue
  2. Allow us 30 days to resolve the dispute
  3. Negotiate in good faith

13.2 Arbitration Agreement (US Users)

For disputes that cannot be resolved informally:

  • Disputes will be resolved by binding arbitration (not court litigation)
  • Arbitration conducted under AAA rules
  • Location: Colorado
  • Each party pays their own legal fees
  • Class action waiver – No class arbitration or representative actions

Exceptions:

  • Small claims court (disputes under $10,000)
  • IP infringement claims
  • Violations of Terms requiring injunctive relief

13.3 Governing Law

These Terms are governed by the laws of Colorado, United States, without regard to conflict of law principles.

14. Termination

14.1 Termination by You

You may terminate your account at any time by:

  • Using the support widget on our website
  • Using the account deletion feature in settings

Upon termination:

  • Your subscription will not renew
  • Access ends at the end of the billing period
  • Data deletion requires membership cancellation first – After cancellation, your account and practice data remain accessible unless you explicitly request deletion via the support widget (see Privacy Policy)

14.2 Termination by Us

We may suspend or terminate your account immediately if:

  • You violate these Terms
  • You engage in fraudulent activity
  • You abuse or exploit the Service
  • Required by law

Upon termination by us:

  • You lose access immediately
  • No refunds for remaining subscription time (except at our discretion)
  • You remain liable for any outstanding payments

14.3 Effect of Termination

Upon termination:

  • Your license to use VoSci ends
  • We may delete your account data per our Privacy Policy
  • Sections that should survive termination remain in effect (e.g., liability, indemnification)

15. Changes to These Terms

We may update these Terms from time to time.

When we make changes:

  1. We’ll update the “Last Updated” date at the top
  2. We’ll notify you via email (for significant changes)
  3. We’ll post a notice on the platform for 30 days

Your continued use of VoSci after changes means you accept the updated Terms.

If you do not agree to the changes, you must discontinue using the Service and may cancel your account.

16. General Provisions

16.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and VoSci.

16.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

16.3 No Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

16.4 Assignment

You may not assign these Terms to anyone else. We may assign our rights and obligations to a successor or affiliate.

16.5 Force Majeure

We are not liable for failures or delays caused by events beyond our reasonable control (e.g., natural disasters, pandemics, government actions).
